Terms and Conditions applicable to a buyer of Products using www.shopbarnet.co.uk
These terms and conditions are the contract between you and Barnet TV Limited (“us”, “we”, etc). By visiting or using Our Website, you agree to be bound by them. Our Sellers will also impose terms and conditions to which your contract with them for the purchase of Products will be subject.
Barnet TV Limited is a company incorporated in England & Wales, with company number 9692573, whose registered address is Churchill House 120 Bunns Lane, Mill Hill, London NW7 2AS.
Are you under 18 years? Sorry, but we deal only with people who are legally able to enter into a binding contract. Please ask someone over 18 to buy a Product on your behalf.
If you use Our Website, you do so in accordance with these terms. If you are unable to accept these terms, your only remedy is to leave Our Website and stop using the Services.

- Shop Barnet is neither a buyer nor seller of Products offered for sale in any form.
- Shop Barnet is a marketplace. We are agents of a Seller only to the extent of use of Our Website as a platform for sale of their Products and for collection and forwarding of your money.
- We are not responsible to you further than to take your money and pass it to the Seller. We cannot give any undertaking that goods and/or services you purchase from Sellers through the Site will be of satisfactory quality, and this and any other such warranties (whether express or implied) are disclaimed by us to the fullest extent permitted by law. This disclaimer does not affect your statutory rights against the Seller. We do not review or control, and are not responsible in any way for, listings provided by Sellers and we do not possess or hold any items offered for sale by Sellers through Our Website.
- We welcome any comment or complaint about a Seller, which you make through Our Website. We may act upon a complaint in our discretion, for the benefit of the body of Shop Barnet
- We are not responsible for delivery of any Product you order or for the returns and repayment procedure should you decide to return a Product for any reason.
- These terms and conditions regulate the business relationship between you and us. By using Our Website free of charge, you agree to be bound by them.
- We provide a market place for the supply of Products. We are in no way responsible for:
- your locating and ordering a Product;
- your choice of a Product;
- any aspect of the provision of the Product;
- refund payment for any Product;
- any complaint about any Product.
- In any dispute with a Seller, you should deal only with the Seller. We have neither legal obligation nor detailed information about the Product.
- We may change this agreement in any way at any time. The version applicable to you is the version Posted on Our Website at the time you use Our Website.
- Your account and personal information
- When you visit Our Website, you accept responsibility for any action done by any person in your name or under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

- The buying procedure
- Shop Barnet is not responsible for the fulfilment of your contract to buy a Product.
- Prices listed on Our Website by Sellers are inclusive of any applicable sales tax.
- Unless it is clear to the contrary, you may assume that every sale is made by the Seller in the course of his business.
- Products may be offered for sale subject to any discount or promotion arranged between Shops’ Noir and the Seller.
- Subject to discounts and promotions, Products are offered for sale at a fixed price. VAT may be due and will be shown separately. If not shown, it will not be charged.
- All Products will be subject to a delivery charge which will be shown at the pay point. The delivery charge will be fixed by the Seller for each Product offered for sale. It may be changed at the discretion of the Seller. Once you have bought an item, the delivery charge offered to you cannot be increased.
- Neither we nor the Seller can be responsible for action by any governmental authority. We do not know and are not responsible for duties, taxes, delays or impounding of any item.
- You are required to pay in the currency in which the Product is listed for sale on Our Website.
- Every sale will be subject to the laws applicable but there shall not be implied any right which is neither a legal right nor set down in these terms and conditions.
- Purchases of goods you make with the Sellers may only be paid for using PayPal, Stripe or other payment method made available from time to time through Our Website. We do not process any payments on behalf of Sellers. You will be directed to a secure third party payment site to make payment to your Seller.
- For security purposes (yours and ours) we will not permit more than a maximum number of transactions with you in a given period of time.
- Security of your credit card
We take care to make Our Website safe for you to use.
- Card payments are not processed through pages controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment.
- Consumer protection: cancellation and refunds
This and the following paragraph are not contractually part of this agreement. This is a statement of your rights as a consumer under the Consumer Contract (Information Cancellation and Additional Charges) Regulations 2013 (“the Regulations”) and of the procedures with which all our Sellers have been asked to comply. We have no responsibility if they fail to do so. If you have any problem with the Product you have purchased from Our Website please refer to the Seller. Your contract is with them. They have the information and systems to be able to help you.
- Products you buy here are delivered within 30 days from the day you place an order unless agreed otherwise between yourself and the Seller.
- The following rules apply to cancellation of your order:
- If you have ordered a Product, but not received it, you may cancel your order without giving a reason. You will have no obligation and you will be entitled to a refund of your money.
- If you have ordered a Product, and received it, you may cancel your order at any time within 14 days of the date your received it. You must tell your Seller that you wish to cancel. You must also send the Product back to the Seller within that same 14 day period.
- The Seller will return your money subject to the following conditions:
- the Seller receives the Product in a condition in which he can re-sell it at full price.
- you comply with the Seller’s procedure for returns and refunds. The Seller cannot return your money unless he knows who sent back the product.
- The option to cancel your order is not available:
- if you purchase sealed goods which relate to health or hygiene, and they become unsealed after delivery, or cannot be re-sold for some other reason;
- if they are a hard medium for a product in soft copy, which comes to you sealed and is returned to them unsealed.
- If the goods are somehow mixed with other goods so that they cannot identify or easily separate them.
- You are responsible for the cost of returning the Product. Your Seller has no obligation to refund your cost of re-packing and returning the Product.
- On return of the product, and subject to the above clauses, you will be entitled to a refund within 14 days.
- Liability for subsequent defects
- The following rules apply to the return of the Product you claim to be faulty or defective in any way:
- the Product must be returned to the Seller as soon as any defect is discovered but not later than six months from receipt by you.
- the Seller does not have to accept returns unless there was a defect in the Product at the time of purchase, or the Seller has agreed in correspondence that you may return it.
- before you return the Product to the Seller, please carefully re-read the instructions and check that you have assembled it correctly / complied with any provisions relating to the power supply, plugs and sockets / other.
- The Seller will return your money subject to the following conditions:
- you comply with the Seller’s procedure for returns and refunds.
- the Seller cannot return your money unless he knows who sent back the Product.
- If the Seller agrees that the Product is faulty, the Seller will:
- repair or replace the Product, or
- refund the full cost you have paid including the cost of returning the Product.
- Products returned
These provisions apply if you buy from a Seller other than as a consumer. The following rules apply to return the faulty Product:
- The Seller does not accept returns unless there was a defect in the Product at the time of purchase, or the Seller has agreed in correspondence that you may return it.
- Before you return a Product to the Seller, please carefully re-read the instructions and check that you have assembled it correctly and complied with any provisions relating to the power supply, plugs and sockets.
- The Products must be returned to the Seller as soon as any defect is discovered but not later than 14 days.
- So far as possible, a Product should be returned:
- with both Product and all packaging as far as possible in their original condition;
- securely wrapped;
- including the Seller’s delivery slip;
- at your risk and cost.
- We advise you to follow the returns procedure set out on your Seller’s website or otherwise in his terms and conditions, if any. If you do not do so, the Seller may be unable to identify you as the sender of the Products.
- If the Seller agrees that the item is faulty, the Seller will:
- refund the cost of return carriage;
- repair or replace the Product as he chooses.
- If a Seller does not provide a refund for a defective product or cancelled order please report the matter to us and to our payment service provider, PayPal or Stripe. PayPal or Stripe will conduct an investigation into the matter.
- How we handle your Content
- Our Privacy Notice governs how we handle your Content.
- If you Post Content to any public area of Our Website it becomes available in the public domain. We have no control who sees it or what anyone does with it.
- Even if access to your text is behind a user registration it remains effectively in the public domain because someone has only to register and log in, to access it. You should therefore avoid Posting unnecessary confidential information.

- Interruption to the Shop Barnet Service
- We give no warranty that the Shop Barnet Service will be satisfactory to you.

- your breach of this agreement;
- your failure to comply with any law;
- a contractual claim arising from your use of the Services and purchase of a Product.
- Dispute resolution
In this paragraph the term “ADR Provider” means an approved body under the Alternative Dispute Resolution for Consumer Dispute Regulations 2015.
The following terms apply in the event of a dispute between the parties:
- If you are not happy with our services or have any complaint then you must tell us by email message to email@example.com or an updated address which you will find on Our Website.

- For the purposes of the Data Protection Act 1998 and any other data protection legislation you consent to the processing of your personal data (in manual, electronic or any other form) relevant to this agreement, by us and/or any agent or third party nominated by us and bound by a duty of confidentiality. Processing includes but is not limited to obtaining, recording, using and holding data and includes the transfer of data to any country in any part of the World.
- If you are in breach of any term of this agreement, we may:
- publish all text and Content relating to the claimed breach, including your name and email address and all correspondence between us and our respective advisers; and you now irrevocably give your consent to such publication.
- terminate your account and refuse access to Our Website;
- remove or edit Content, or cancel any order at our discretion;
- issue a claim in any court.
- Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.
- No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.

- We shall not be liable for any failure or delay in our performance of this agreement which is caused by circumstances beyond our reasonable control, including any labour dispute.
- In the event of any conflict between any term of this agreement and the provisions of the articles of a limited company or any comparable document intended to regulate any other corporate or collective body, then the terms of this agreement shall prevail.
- This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.
- The validity, construction and performance of this agreement shall be governed by the laws of England and Wales and you agree that any dispute arising from it shall be litigated only in England and Wales.
